Supporting students with special needs

Context

In the context of and for the purposes of supporting students with special needs, the University of Namur processes the data of students and persons who draw up a certificate concerning special needs or who intervene in the support of the students concerned.

Categories of personal data processed and purposes of use

For the purposes of managing the support of students with special needs, the University of Namur processes data in the following categories

  • General identification data [category including the following type of data: surname, first name, postal address, e-mail addresses, copy of identity card, identity photograph, telephone number, etc.]
  • Identifiers assigned by UNamur [category grouping the following type of data: student number, internal number, eID for access to internal resources, access card identifiers, student card number ...]
  • Personal characteristics data [category grouping the following type of data: date of birth, gender, place of birth, marital status and nationality, residence status in Belgium, mother tongue, languages spoken, possession of a driving licence ...].
  • Data relating to the student's academic career [category grouping the following type of data: data relating to the student's academic career, the student's annual programme - teaching units followed -, grades, credits, mentions, diplomas obtained, country of issue of the diploma(s), jury opinions, disciplinary decisions and appeals, end-of-study work, internships carried out, etc.].
  • Data related to the specific needs of students [category grouping the following type of data: data related to the specific needs of the student, the support plan, the accommodations granted...]
  • Professional data [this category includes the following type of data: data relating to the profession or professional activities, the function in an entity outside the University, professional affiliations...]

This data is used to :

  • Manage the receipt of requests for support for students with special needs
  • Manage the validation of the conditions required to benefit from an accommodation
  • Manage the establishment of an individualised support plan, its adaptations and renewals
  • Managing the implementation of reasonable accommodation measures (including the provision of equipment)
  • Managing the support of students with special needs in the event of mobility (Erasmus programmes, etc.)
  • Carrying out surveys on the operation of facilities
  • Assessing support needs, including statistical analysis
  • Inviting students with special needs to participate in activities or workshops set up by the University

Basis of lawfulness of data processing

The data processing activity is carried out insofar as it is necessary to perform a task in the public interest related to education (Article 6, 1, e) of the GDPR).

Processing of special categories of personal data

In pursuit of the above-mentioned purposes, the University of Namur is also required to process data relating to health. These data essentially concern difficulties linked to a state of health which justify adjustments for the benefit of the student concerned (type of disorder, time of its appearance, medical certificates, etc.).

The processing of data in this special category is justified by the fact that it is necessary for important public interest reasons (Article 9, 2, g). As mentioned above, the support of students with special needs is covered by a decree of 30 January 2014 on inclusive education for students with disabilities.

Categories of data subjects

The categories of persons whose data are processed for the purposes of the activity are as follows:

  • Registered students
  • Former students
  • Family members or relatives of the data subject

The University also keeps third party certificates issued to attest to the specific needs of the students concerned in which the data of the persons who issued them are mentioned.

Data sources

The data included in the processing activity come from the following source(s):

  • The person himself/herself has provided them once the application file is submitted by the student
  • The data are generated by an activity of the person within the University, to take account of the accommodations in the context of teaching activities and tests
  • The data is provided by a third party or comes from a third party database
  • The data may be provided by third parties involved in the support (e.g. AVIQ) or by another higher education institution with which the file for obtaining specific status has been drawn up or with which the student is registered (e.g. in the context of an Erasmus programme).

Data recipients

Data are processed only by persons and services of the University for the purpose of carrying out the activity. The internal recipients of the data belong mainly to the following categories

  • University administrative services staff
  • Faculties and departments staff

The external recipients of data belong to the following categories

  • Teaching partners insofar as the file of acceptance of the status of students with special needs is communicated to the other institutions where the student concerned registers, at the request of the student concerned.
  • Public Service entities insofar as, in the context of support, data may be exchanged with third party organisations involved (AVIQ, etc.).

Characteristics of the processing

The storage period is determined according to the need to keep the data for operational purposes in accordance with the purpose of their use.  The file must be kept for the entire period during which the student pursues his or her study programme at the University of Namur and must be able to be transmitted to another institution in which the student concerned pursues his or her studies if the file was initially set up at the University of Namur.
